Efforts to deny a protester’s constitutional right to be a nuisance are “unconstitutional,” a federal judge in Baltimore ruled Thursday.

A federal judge in Baltimore said state and local authorities must allow a protester to exercise his First Amendment right and occupy the same area that Maryland officials want to use to clear streets so construction can begin on the new Red Line metro, the Baltimore Sun reports.

The protesters, Green Knight Ambassadors, plan to block a section of Baltimore for “21 days to bring pressure on the political system to halt the practice of fossil fuel production, which is posing a threat to all of us and our future,” according to the group’s website.

The state has been trying to move the protesters away from the construction site and, in its most recent court filing, said that although the protesters have the right to protest, they need to make way for protesters they are not directly involved with.

“The first amendment does not allow them to stand in the way of construction that directly interferes with the rights of others who have a contractual or other interest in the property,” a lawyer representing the state told the court.

Judge Catherine Blake said that the protesters could not be told to move aside because they were “unsanctioned agents” of the real estate development firm tasked with building the Red Line project, according to the Sun.

“This litigation presents a thorny question of first impression in the federal courts. That question is whether the First Amendment protects a speech-and-assembly zone from being (partially) destroyed,” Blake said. “The Court finds, however, that the notion of a ‘free speech zone’ is unconstitutional.”

Blake said that the attorney for the state is correct that a prohibition on only certain protesters from standing in a certain area would be unconstitutional because it would “discriminate against disfavored speech and would amount to a policy of content-based speech regulation that is unconstitutional.”

“The First Amendment, like other constitutional provisions, must be construed in the light of the basic principles that gave it birth and with recognition of the differences that age and experience have wrought,” she said.

Blake wrote that there is nothing unconstitutional with authorities telling “a speaker not to take a particular approach.”
